A New Regulatory Paradigm

Cambridge University Press eBooks, pp. 214–258

Abstract

This chapter proposes a system of progressive ecosystem regulation. This new type of regulatory framework is based on the observations on ecosystem competition developed throughout the book. The regulatory system integrates a rules-based, principles-based, and competition law-based approach to digital regulation with a focus of stimulating long-term competition between ecosystems. The purpose of the regulatory framework is to prevent abuses of ecosystem power as to open up the market for competition by disruptive entrants. The chapter explains how the regulatory system works by creating three regulatory pools, setting out its objectives, and giving clear examples of regulatory burdens that can be imposed on undertakings of varying sizes. The proposed regulatory framework provides a wholly novel perspective on how digital markets should be regulated and the role of ecosystems in developing this regulation. It proposes a structured and coherent route towards the introduction of long-term, sustainable, and healthy competition across digital markets.
